These Terms of Use (“Terms”) govern the relationship between you (“you”, “user”) and Wishes DNA, Lda (“we”, “Wishpicks”, “Service”) when you access the Wishpicks platform, create wishlists, product collections, use price-tracking features, partner promo codes, and other functionalities.
BY ACCESSING THE WEBSITE, USING THE WISHPICKS PLATFORM, OR CREATING AN ACCOUNT, YOU CONFIRM THAT:
- you have read and accept these Terms;
- you have reviewed our Privacy Policy and agree to how we process data;
- if you do not agree with the Terms — do not use the Service.

1. Who we are
The Wishpicks platform is owned and operated by:

Wishpicks is a brand of Wishes DNA, Lda, a company registered in Portugal and operating in accordance with Portuguese law and applicable European Union legislation.
2. Services Covered by These Terms
These Terms apply to all Wishpicks services, including:
- the website wishpicks.com and its localized versions;
- the Wishpicks progressive web application (PWA);
- emails, push notifications, and other messages related to the Service;
- the business dashboard and partner integrations;
- official Wishpicks pages on social media, unless otherwise specified by separate rules.
Together, these services are referred to as the “Wishpicks Platform” or simply the “Service.”
Our services are designed for consumers who use the Service for personal, non-commercial purposes, as well as for business users (stores, brands, influencers) to the extent described in separate commercial agreements.
3. Definitions
The following terms are used in these Terms:
- “Site” / “Wishpicks Platform” – the website wishpicks.com, its subdomains, and related online services that provide Wishpicks functionality.
- “Visitor” – an individual using the Service without creating an account (guest), who may still interact with certain features (for example, viewing wishlists or reserving gifts).
- “User” – an individual who has created an account on Wishpicks and uses extended features of the Service.
- “Account” – a registered user profile on the Wishpicks Platform.
- “Influencer” – a user who utilizes the Service to create public product collections, recommendations, and promotional materials for their audience.
- “Wishlist” – a list of products or services created on the Service that the user plans to purchase or would like to receive as a gift.
- “Wish Picks” / “Product Collection” – a public or semi-public collection of products/services created by a user or influencer for inspiration, recommendations, or promotional purposes.
- “Gift Reservation” – a feature allowing a third party to indicate that they plan to purchase a specific item from a wishlist (to avoid duplicate gifts).
- ”Partner Links” / “Affiliate Links” – special URLs to third-party stores that may include tracking parameters for measuring clicks and potential rewards.
- ”Partner Store” – an online store that has a commercial relationship with Wishpicks (e.g., through an affiliate program). Partner stores may support automatic price tracking for items saved by users.
- ”Price Tracking” – automated monitoring of product prices on third-party websites for items saved in a user's wishlist, as described in Section 10.
- ”Price Alert” – an email notification sent to a user when a tracked product's price drops below a configured threshold.
- ”Plus Tracking” – enhanced price tracking available exclusively to Wishpicks Plus subscribers, providing more frequent checks and additional features for items from any online store.
- ”Wishpicks Plus” – a paid subscription that provides enhanced features of the Service, including Plus Tracking, price history charts, and additional customization options, as described in Section 10.
Unless explicitly stated otherwise, “you” refers to both registered users and visitors.
4. Nature of the Service
Wishpicks is a platform for:
- managing personal and shared wishlists;
- planning gifts and events;
- tracking price changes for products in your wishlists (see Section 10 for details on free and paid tracking);
- creating product collections and curated lists;
- interacting with partner stores through links and promo codes.
We:
- provide you with a tool for organizing your wishes and shopping plans;
- are not an online store and do not sell products directly;
- are not a party to any purchase agreement between you and a third-party store, even if you accessed it through Wishpicks.
We strive to keep the Service available, stable, and secure; however, we do not guarantee uninterrupted operation or the absence of technical errors (see the sections “Disclaimer of Warranties” and “Limitation of Liability”).
5. Access to the Service and Account Creation
5.1. Who May Use the Service
You may use Wishpicks as:
- a Visitor (anonymous user) — without creating an account;
- a Registered User — with access to extended functionality.
By using the Service in any way, you represent and warrant that:
- you are at least 16 years old (or any other minimum age required by the laws of your country);
- you have full legal capacity to enter into this agreement;
- you use the Service for personal, non-commercial purposes, unless otherwise agreed with us.
If you use the Service on behalf of a company, brand, or organization, you confirm that:
- you are authorized to act on behalf of that organization;
- you agree that these Terms are binding for that organization.
5.2 Using the Service Without Registration (Anonymous Account)
Wishpicks allows you to use most core features without creating an account, including:
- creating wishlists;
- adding products;
- reserving gifts;
- viewing content available without authentication.
In such cases, your data and settings are stored as an anonymous account, associated with your device through cookies (session and persistent).
Important:
If cookies are deleted manually, automatically, or by third-party software,
or if you switch your browser/device,
or enable “incognito/private mode” or cookie blockers —
→ access to the anonymous account, including your wishlists, will be lost permanently and cannot be restored.
An anonymous account is not linked to any email address, which means Wishpicks has no technical ability to verify your identity or recover your data once cookies are lost.
To ensure stable access to your wishlists and reservations, we recommend registering an account.
5.3. Account Registration
To access additional features (sync across devices, profile editing, activity history, business/influencer tools, etc.), you must create an account.
You may register using:
- Google or Facebook; or
- an email address with confirmation via a “magic link.”
You agree to provide accurate and up-to-date information and keep it current.
We are not responsible for consequences arising from incorrect or outdated information provided by you.
5.4. Account Security
You are responsible for:
- keeping access credentials to the Service secure (email access, Google/Facebook accounts);
- all actions performed through your account.
If you suspect unauthorized access, we recommend:
- updating passwords for services you use to log in;

5.5. Influencer Account and Business Features
A user may request access to extended capabilities (Influencer account or business dashboard). We may:
- request additional information (brand name, links, activity description);
- approve or reject the request at our sole discretion.
You are solely responsible for complying with applicable tax, advertising, and disclosure regulations, including marking collaborations (“advertising,” “affiliate,” etc.).
5.6. Account Closure
You may:
- delete your account in the settings; or
- send us a request to delete it.
We may delete or block your account if:
- you violate these Terms or applicable laws;
- you misuse the Service (spam, fraud, technical attacks, etc.).
Details regarding processing and deletion of personal data are described in our Privacy Policy.
6. Permitted and Prohibited Use
By using the Service, you agree that you will NOT:

Use the Service in any way that:
- violates the law, these Terms, or the rights of third parties;
- is fraudulent, deceptive, discriminatory, abusive, hateful, or contains hate speech;
- infringes intellectual property rights, privacy rights, or any other legal rights.

Use automated tools (bots, scrapers, spiders, etc.) to:
- mass-collect data from Wishpicks;
- bypass technical limitations or security mechanisms.

Attempt to:
- gain unauthorized access to other users’ accounts, our servers, or databases;
- test or probe vulnerabilities without our explicit written consent.

Upload or distribute:
- viruses, trojans, malicious code, scripts, or any tools that may harm the Service or data of other users.

Use the Service for:
- sending spam or large-scale unsolicited messages;
- commercial activities that have not been approved by us (for example, reselling access to an account).
Wishpicks reserves the right to suspend or limit access, as well as remove content that, in our good-faith judgment, violates these Terms or applicable laws.
7. User Content
7.1. What Counts as User Content
“User content” includes:
- titles and descriptions of wishlists;
- notes added to products;
- images you upload;
- comments, reviews, recommendation texts;
- your nickname, profile photo, and other publicly visible information.
7.2. Your Warranties
By posting content on Wishpicks, you represent that:
- you have all necessary rights to use and publish this content;
- the content does not infringe the rights of third parties (copyrights, trademarks, image rights, etc.);
- the content does not contain prohibited material (hate speech, pornography, calls for violence, fraud, etc.).
7.3. License to Use Your Content
You retain all intellectual property rights to your content.
By posting content on the Service, you grant Wishes DNA, Lda the following licenses:
1) Service Operation License (revocable)
You grant Wishes DNA, Lda a non-exclusive, revocable, royalty-free, worldwide license to:
- store, cache, and technically process your content (optimization, resizing, preview generation);
- reproduce, display, and distribute your content as needed for the functioning of the Platform (your wishlists, shared access, public collections, etc.).
You may delete or modify your content at any time, and this license will cease for all future uses — except for the cases listed below.
2) Promotional Materials License (limited irrevocability)
If your content (or interface fragments containing it) has already been used in public Wishpicks promotional materials, including:
- presentations, posts on Wishpicks social media;
- demo screenshots, interface mockups;
- pages of marketing campaigns,
you grant Wishes DNA, Lda a non-exclusive, royalty-free, limited irrevocable license that allows us to:
- continue using such materials in their already existing form;
- keep them in available archives or public channels.
This is necessary because complete removal of already published materials is not always technically or legally possible (e.g., if shared by third-party platforms).
3) Backups and Caches
Your content may temporarily persist in:
- system backups,
- CDN caches, browser caches, or infrastructure services.
These copies will be automatically removed within standard retention cycles.
8. Obtaining Data From Third-Party Websites (scraping / extraction)
Wishpicks allows users to add products or services to their wishlists by pasting a link to a page of a third-party online store.
After such a link is provided, Wishpicks (or a contracted technical provider) may automatically:
- read publicly available information from the page (product name, description, image, price, currency, and other metadata);
- store such data in a minimal necessary amount for correct display of the item in the user’s profile.
Wishpicks does not perform large-scale or automated scanning of websites, and processes only those URLs explicitly provided by the user.
8.1. Limits of Wishpicks’ Responsibility
Information obtained from third-party websites:
- may be outdated, incomplete, or inaccurate;
- may change without notice;
- may display incorrectly if the third-party site changes its structure.
Wishpicks does not guarantee the accuracy, freshness, completeness, or availability of data retrieved from third-party websites and is not responsible for:
- the operation or availability of the external resource;
- changes in layout, structure, or content of the page;
- any technical restrictions imposed by the seller’s website;
- copyrights or other proprietary rights related to third-party website content.
Wishpicks does not modify, sell, or reproduce full copies of pages — only the minimal fragments required for creating a user’s wish item.
8.2. Data Processing Only Upon User Request
Data extraction from third-party websites occurs only after the user voluntarily provides a URL.
Wishpicks does not crawl or index external websites independently and does not start automatic updates without user action, except for automated price-tracking updates described in Section 10, which the user may enable or disable at any time.
8.3. Technical Limitations of Third-Party Websites
Wishpicks may use external technical providers to process URLs (for example, to generate a page preview).
If information cannot be technically retrieved, Wishpicks may:
- fail to display some data,
- or stop updating metadata for a specific domain.
8.4. Requests From Rights Holders or Merchants
If you are the owner of a store, brand, or online platform and you do not want Wishpicks to retrieve metadata from your website, you may submit a request:
Upon receiving the request, Wishpicks will stop automatically retrieving data from the specified domain.
Wishpicks reserves the right, but is not obligated, to notify users about restrictions related to specific store URLs.
8.5. Notice of Potential Rights Infringement
If you believe that certain content on Wishpicks infringes your rights (copyrights, related rights, trademarks, commercial identifiers), you may submit a complaint:
We will review the request and take appropriate action.
8.6. Store Opt-Out from Price Tracking
Certain stores may request that Wishpicks not perform automated price monitoring on their products. When a store opts out:
- no automated price checks occur for products from that store;
- no price change notifications are sent for those products;
- the displayed price may not reflect the current price on the store's website;
- this applies regardless of your subscription status or notification settings.

9. License to Use the Service
We grant you:
a revocable, limited, non-exclusive, non-transferable, and non-sublicensable license to access and use the Wishpicks Platform in accordance with these Terms.
This license:
- does not give you the right to resell the Service or any part of it;
- does not permit copying, modifying, decompiling, reverse engineering, or otherwise attempting to obtain the source code;
- does not allow creating derivative works based on the Service without our written consent.
All rights not expressly granted to you are reserved by Wishes DNA, Lda.
10. Paid Features and Subscriptions
10.1. Free Price Tracking (Partner Stores)
When you enable Price Alerts in your notification settings, Wishpicks automatically monitors prices on products in your wishlists from supported partner stores. This means:
- we periodically check the listed price on the product page for items you have saved;
- price checks occur on a best-effort basis, typically every 1 to 3 days for supported stores;
- you will receive email notifications when a product's price drops by 10% or more from the price recorded when tracking began;
- price tracking applies to all wishlist items from supported partner stores — you do not need to enable it individually for each item;
- you can disable Price Alerts at any time from your notification settings, which will stop all automated price monitoring and notifications.
Not all stores support price tracking. Some stores may restrict or prohibit automated price monitoring under their own terms. For these stores, Wishpicks does not perform automated tracking or send price alerts, regardless of your notification settings (see also Section 8.6).
10.2. Wishpicks Plus
Wishpicks Plus is a paid subscription that provides enhanced features, including but not limited to:
- Plus Tracking on items from any online store (not limited to partner stores), with checks approximately every 12 hours;
- custom price drop thresholds per item (e.g., alert only when the price drops 20% or more);
- price history charts showing how the price has changed over time;
- daily price drop alert emails;
- weekly price digest emails summarizing price activity across your tracked items;
- increased tracking capacity (up to 50 non-partner items, unless a different limit has been agreed).
Plus Tracking remains active even when Price Alerts are disabled in your notification settings — however, no notifications will be sent until you re-enable alerts.
The specific features, pricing, and limits of Wishpicks Plus are described on the Wishpicks Plus page and may be updated from time to time.
10.3. Price Tracking Data
When price tracking is active for an item in your wishlist (whether through free partner tracking or Plus Tracking), Wishpicks collects and stores:
- the current listed price and currency on the product page;
- the date and time each price was recorded;
- product availability status (in stock / out of stock) where detectable.
For Plus-tracked items, price history is retained for the duration of your subscription and remains accessible during the grace period described in Section 10.5. For items tracked through the free partner store service, price data may be retained for up to 90 days.
Wishpicks does not compare prices across different stores. Each product links exclusively to the store you originally saved it from.
10.4. Subscription and Billing
- Wishpicks Plus is a recurring subscription billed according to the billing cycle of the plan you select at checkout (e.g., monthly).
- Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. By subscribing, you expressly authorise recurring charges to your chosen payment method at the start of each billing cycle.
- Payment is processed securely through Stripe, our third-party payment processor. Wishpicks does not store your full card details — all payment data is handled by Stripe in accordance with PCI DSS standards. Stripe acts as an independent data controller for your payment data; its processing is governed by Stripe's Privacy Policy.
- You agree to pay all applicable fees and taxes associated with your subscription.
- Prices may vary by currency and region. The price displayed at checkout is the price you will be charged.
Pre-contractual information
Before completing your purchase, you are shown a summary of: the service description, the recurring price (inclusive of applicable VAT), the billing cycle, and how to cancel. By clicking the payment button (labelled to clearly indicate an obligation to pay, e.g., "Subscribe — €3/month"), you confirm having received this information, in accordance with Article 8(2) of Directive 2011/83/EU.
10.5. Cancellation
- You may cancel your Wishpicks Plus subscription at any time from your account settings or through the Stripe billing portal.
- Upon cancellation, your Plus features remain active until the end of your current billing period. You will not be charged again after cancellation.
- After the billing period ends, your account reverts to the free plan. Plus-tracked items enter a 7-day grace period during which tracking and full price history remain accessible.
- After the grace period expires, Plus Tracking stops for those items. Items from supported partner stores continue to receive free price tracking if you have Price Alerts enabled in your notification settings.
- Once Plus Tracking expires, full price history is no longer accessible. You will still be able to see a summary of recent prices and all-time high/low values, but detailed historical charts require an active subscription.
10.6. Subscription Pause
- When you initiate cancellation, you may be offered the option to pause your subscription for up to 30 days instead of canceling.
- You may pause your subscription once per 12-month period. If you have already used a pause within the last 12 months, the pause option will not be available.
- During the pause period, you retain access to Plus features. No payment is collected for the paused period.
- At the end of the pause period, your subscription resumes automatically and billing continues from the next cycle.
10.7. Payment Failures and Past-Due Accounts
- If a payment fails, we will notify you by email and Stripe will attempt to retry the charge according to its retry schedule (typically 3-4 attempts over several weeks).
- During the retry period, your Plus features remain active.
- If all payment retry attempts fail, your subscription will be canceled, and the cancellation terms in Section 10.5 apply.
10.8. Conformity and Remedies
We will maintain Wishpicks Plus features in conformity with what was described at the time of your subscription for the duration of your billing period, and will supply necessary updates (including security updates) throughout your subscription, in accordance with Directive (EU) 2019/770 as transposed into Portuguese law (Decree-Law 84/2021).
If Wishpicks Plus fails to conform to what was agreed, you are entitled to:
- request that we bring the service into conformity free of charge and within a reasonable time;
- if we fail to do so, request a proportionate price reduction; or
- terminate the contract and receive a full refund for the affected period.
These remedies are statutory rights under EU law and cannot be waived by these Terms.
10.9. Refunds
- Outside of the conformity remedies described in Section 10.8 and the right of withdrawal in Section 10.10, Wishpicks Plus subscriptions are generally non-refundable.
- If you believe you are entitled to a refund (for example, due to a billing error or service outage), please contact us at support@wishpicks.com. We will review requests on a case-by-case basis.
10.10. Right of Withdrawal (EU Consumers)
If you are a consumer in the European Union, you have the right to withdraw from a digital subscription within 14 days of purchase without giving any reason, in accordance with the EU Consumer Rights Directive (2011/83/EU).
However, because Wishpicks Plus features are made available to you immediately upon purchase, we ask you to provide express consent to immediate performance at the point of checkout. By providing this consent, you acknowledge that:
- you expressly request that we begin supplying Wishpicks Plus immediately;
- you acknowledge that you thereby lose your right of withdrawal once performance has begun;
as permitted under Article 16(m) of Directive 2011/83/EU.
This consent is collected as an explicit acknowledgment during the checkout process and is confirmed in your purchase confirmation email, in accordance with Article 8(7) of the Directive.
If you do not consent to immediate performance, please contact us within 14 days of purchase at support@wishpicks.com to request a withdrawal and full refund.
10.11. Price Changes
- We may change the price of Wishpicks Plus from time to time.
- If we increase the price, we will notify you at least 30 days before the change takes effect, giving you the opportunity to cancel before the new price applies.
- Price changes will take effect at the start of your next billing period after the notice period.
- Promotional or introductory pricing is valid for the stated period only and will revert to the standard price upon expiry.
10.12. Administrative Grants
We may, at our sole discretion, grant complimentary or extended access to Wishpicks Plus features to specific accounts (for example, for testing, promotional, or partnership purposes). Such grants may have a fixed duration and may be revoked at any time.
10.13. Other Paid Features
We may offer additional paid features beyond Wishpicks Plus in the future. The terms of payment, trial periods, renewal, and cancellation for such features will be described:
- on the checkout page;
- in the specific terms of the paid feature.
If special terms for a particular paid feature conflict with these Terms, the special terms take precedence, but only for the specific service they apply to.
11. Links to Third-Party Websites, Stores, and Affiliate Programs
The Wishpicks Platform may contain:
- links to third-party websites, online stores, and marketplaces;
- promo codes, partner offers, affiliate links.
We:
- do not control and are not responsible for the content of such external websites;
- do not guarantee product availability, price accuracy, or delivery terms;
- are not responsible for the seller’s obligations toward you.
Any legal relationship concerning the purchase of goods/services arises directly between you and the respective store/vendor, not with Wishes DNA, Lda.
If a link on Wishpicks is marked as a partner or affiliate link, it means we may receive a commission for a click or purchase, but this does not affect the price you pay, unless explicitly stated otherwise.
12. Reporting Violations and Content Complaints
If you believe that:
- content on the Platform infringes your rights (copyright, image rights, trademarks, etc.); or
- materials are illegal or unacceptable (hate speech, fraud, promotion of violence),
you may send us a notice (complaint) at:

Please include:
- a link to the page or a screenshot of the content;
- a brief description of the issue;
- the reason you believe the content violates the law or your rights;
- contact details for follow-up communication.
We will review the complaint within a reasonable timeframe and:
- may temporarily restrict the visibility of the content;
- may request additional information from you;
- will inform you of the key decision (removal or retention of the content).
If someone abuses the complaint procedure (mass, baseless, or clearly malicious complaints), we may limit or refuse to accept further complaints from that person.
13. Disclaimer of Warranties
You use the Service at your own risk.
To the fullest extent permitted by applicable law, Wishpicks provides the Service:
“as is” and “as available,” without any express or implied warranties, including but not limited to:
– fitness for a particular purpose;
– non-infringement;
– uninterrupted or error-free operation;
– accuracy, completeness, or timeliness of information.
In particular, we do not guarantee that:
- the Service will be available without interruptions, delays, errors, or failures;
- the Service will be compatible with all devices, browsers, or operating systems;
- all security vulnerabilities or bugs will be fixed immediately.
We also do not guarantee and are not responsible for:
- actions or omissions of other users, influencers, or partners;
- products, services, delivery or return conditions of third-party stores;
- correctness, completeness, or availability of information received from third-party sources (e.g., product feeds);
- accuracy, timeliness, or completeness of tracked prices. Prices displayed on Wishpicks may differ from the actual price on the store's website due to regional pricing, promotions, caching delays, or technical limitations. Always verify the final price on the store's website before purchasing.
No oral or written information provided by us creates any additional warranties beyond those explicitly stated in these Terms.
14. Limitation of Liability
To the fullest extent permitted by applicable law:

Wishes DNA, Lda, its affiliates, directors, employees, and contractors shall not be liable for any:
- loss of profit, expected gain, data, opportunities, or reputation;
- indirect, incidental, consequential, special, punitive, or exemplary damages;
- damage or losses arising from:
- the use or inability to use the Service;
- interactions with other users, influencers, or third-party sellers;
- actions, omissions, or unavailability of third-party services (stores, payment platforms, social networks, affiliate networks, etc.);
- inaccuracies or unavailability of data obtained from third-party websites.

If, despite these Terms, liability of Wishes DNA, Lda is established by a competent authority, the total amount of such liability shall be limited to:
the amount you actually paid to Wishes DNA, Lda
for paid features of the Service during the last 12 months,
or, if you made no payments — an amount not exceeding €50. -
The above limitations do not apply if:
- liability arises from intentional misconduct or gross negligence by Wishes DNA, Lda;
- the damage relates to violation of mandatory consumer rights under applicable law;
- the damage concerns life, health, or bodily injury (within limits defined by law).

Nothing in these Terms limits or excludes any rights you may have as a consumer under applicable law.
15. Changes to the Service
We reserve the right to:
- modify, update, or improve the functionality of the Service;
- add, change, or remove specific sections, features, or integrations;
- temporarily restrict access to the Service (e.g., for maintenance).
We will make reasonable efforts to:
- avoid prolonged interruptions;
- avoid degrading your user experience unless necessary.
However, we are not obligated to maintain any specific feature or interface in an unchanged form.
16. Changes to the Terms
We may update these Terms from time to time, for example:
- due to changes in legislation;
- when launching new features or business models;
- to clarify or improve wording.
If we make material changes to the Terms, we will:
- publish the updated version on the Website with the date of revision;
- optionally notify you via email or within the Service interface.
By continuing to use the Service after the updated Terms take effect, you agree to them.
If you do not agree with the updated Terms, you must stop using the Service and, if necessary, delete your account.
17. Term and Termination
These Terms apply:
- from the moment you first access the Service or create an account;
- until the moment when:
- you stop using the Service and/or delete your account; or
- we terminate your access to the Service.
We may suspend or terminate your access to the Service without prior notice if:
- you violate these Terms or applicable law;
- we reasonably believe that your actions harm the Service, other users, or our reputation;
- required by law or by order of a competent authority.
Provisions that by their nature should continue after termination (including sections on intellectual property, limitations of liability, applicable law) will remain in effect after account deletion or termination of access.
18. Governing Law and Dispute Resolution
These Terms and all legal relations between you and Wishes DNA, Lda are governed by:
- the laws of Portugal;
- applicable European Union legislation in the field of consumer protection and data protection.
If you are a consumer, nothing in these Terms:
- deprives you of protections guaranteed by mandatory legal provisions of the country of your habitual residence;
- limits your right to bring a claim in the courts of your country, where such a right is provided by applicable consumer protection law.
